FlowGen Labs Terms of Service

Please read these Terms of Service (the “Terms”) and the Privacy Policy carefully because they govern your use of FlowGen Labs, Inc.’s (“FlowGen”, “we” or “our”) website located at https://flowgenlabs.com/ (the “Site”). To make these Terms easier to read, the Site and any services offered via our Site are collectively called the “Services.”

  • Send any unsolicited or unauthorized advertising, promotional materials, spam, or other forms of solicitation;

  • Reverse engineer any of the software used to provide the Services;
  • Interfere with, or attempt to interfere with, any user, host or network;
  • Collect or store personally identifiable information from the Services from other users without their consent;

  • Violate any applicable law or regulation; or encourage others to do so.

We may monitor access to or use of the Services to operate the Services, ensure compliance with these Terms, and comply with applicable law. We may investigate violations and cooperate with law enforcement.

6. Links to Third Party Websites or Resources

The Services may allow you to access third-party websites or other resources. We provide access only as a convenience and are not responsible for the content, products or services on or available from those resources or links. You assume all risk arising from your use of any third-party resources.

7. Termination

We may suspend or terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you. Upon any termination, discontinuation or cancellation of the Services, certain sections will survive as described in the original terms.

THE SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT.

You will indemnify and hold FlowGen and its officers, directors, employees and agents harmless from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER FLOWGEN NOR ITS SERVICE PROVIDERS WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR DAMAGES FOR LOST PROFITS, REVENUES, SAVINGS, BUSINESS OPPORTUNITY, DATA OR GOODWILL.

11. Governing Law and Forum Choice

These Terms will be governed by and construed in accordance with the laws of the State of California. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco, California.

12. General Terms

  • Reservation of Rights. We and our licensors exclusively own all right, title and interest in and to the Services.
  • Entire Agreement. These Terms are the entire and exclusive agreement between FlowGen and you regarding the Services.
  • Notices. Any notices will be given via email or by posting to the Services.
  • Waiver. Our failure to enforce any right or provision of these Terms will not be a waiver of such right or provision.
